(a) GLK warrants that (i) each Product unit delivered by GLK hereunder shall be free from defects in design specified by GLK, material and workmanship including manufacture, (ii) each Product unit delivered by GLK hereunder will be in strict conformity with the Specification for a period of twelve (12) to thirty-six(36) months (depends on different products) from the date of acceptance of such Product by Customers (“Warranty Period”). Each Product unit delivered by GLK hereunder will be in strict conformity with the Specification. GLK shall have no obligations under this Article for any breach of this warranty caused by misuse, neglect, accident, or improper installation or testing of any Product units by Customers, or by any alteration or modification of any Product units made by Customers without authorization of GLK.
(b) If any defect, or non-conformity to the Specification, in any Product unit is discovered during the Warranty Period, both Parties shall, upon Customers’s written request to GLK, promptly proceed to remedy the situation in accordance with the terms of the Agreement with regards to Service and Maintenance and Quality Assurance. Customers reserves the right to seek any other remedy available under this General Purchase Terms Agreement, any Related Agreement, or at law.
(c) The provisions of subsection (a) above shall apply to any Product repaired or furbished as a replacement unit under the Agreement with regards to Service and Maintenance and Quality Assurance as well.
(d) In addition to the warranties set forth in subsection (a) above, GLK warrants that (i) each Product sold by GLK to Customers shall be new and merchantable, and fit and sufficient for the particular purpose of Customers and end user of the Product to the extent known to GLK, and (ii) all services furbished by GLK under this General Purchase Terms Agreement or any Related Agreement including the Agreement with regards to Service and Maintenance and Quality Assurance, shall be performed in a professional, workmanlike and competent manner.
(e) GLK provide free spare units or free spare parts and technical supports for customer’s after services.
(f) During the warranty time, customer can return the defective products back to GLK HK warehouse. GLK will repair for free and send back to customer. The freight from customer’s country to GLK HK warehouse is on customer’s account, the freight from China to customer is on GLK’s account.
(g) This Limited Warranty does not cover any third party software, settings, content, data or links included or downloaded in the product, whether included during installment assembly, shipping or any other time in the delivery chain or otherwise and in any way acquired.
